Article 16, Standard of Practice 16-16 reads as follows:
ALL DEALINGS concerning property exclusively listed OR with buyers who are subject to exclusive Buyer Representation Agreements shall be carried on with the client’s representative and NOT with the client EXCEPT with 1) the consent of the client’s representative OR 2) EXCEPT where such dealings are INITIATED BY THE CLIENT.
REALTORS® shall not knowingly provide substantive services concerning a prospective transaction to prospects who are parties to exclusive representation agreements, except with the consent of the prospect’s exclusive representative or at the direction of the prospect.
If a seller contacts you, know what you can and cannot do if the listing has not yet expired.
If a buyer contacts you, determine whether or not he/she is a party to a buyer representation agreement.
