Is a Text Message Contractual?

The Statute of Frauds requires that all real estate agreements be in writing and signed by the parties to be enforceable. Text messages between agents are merely conversation. While a text message or email might express intent at the moment, a judge might not find it enforceable in court. If any agreement is meant to be contractual, it should be properly signed and delivered, such as required written notice for a contract extension or written notice to remove a "first right of refusal" contingency.
